Confidentiality of data In accordance with Legislative Decree 196/2003, JO Group states that all efforts are made to protect the confidentiality and privacy of visitors to its Internet site. As a general policy, no personal information is automatically collected about visitors to the site, nor are “cookies” used except when viewing the databanks. However, it should be noted that information may be collected, in specific parts of the site, about the way visitors connect in order to provide the best performance for viewing the site. This mainly relates to information about the type of browser used, the type of operating system and the name of the IP address of the visitor. Information is also taken – solely in aggregate form so that individuals cannot be identified – on the number of visitors and the corresponding statistics. The e-mail addresses and other personal information will only ever be collected if intentionally provided by the visitor and, in this case, they will not be used for any other purpose than that indicated. It is explicitly excluded that such data will be used for marketing, promotions or any other commercial activity. Privacy Information to the Data Subject as per Section 13, Legislative Decree 196/2003 JO Group, acting as “Data controller”, informs you that the personal data collected will be processed, even by IT and telecommunications systems, in compliance with the Legislative Decree 196/2003, “Personal Data Protection Code” (hereafter the “Code”) applying the principles of correctness and lawfulness, assuring your confidentiality and your rights. Such data will be used for the purposes hereafter indicated: (a) pre-contract and contract information; (b) activity of selection and recruitment of human resources; (c) fulfillment of law obligations, such as accounting and tax obligations; (d) fulfillment of contract obligations; (e) surveys on needs, observations and level of satisfaction of customers regarding products and services marketed by the company; (f) historical data record keeping. The data will be processed by JO Group “Persons in Charge” and can be disclosed or communicated, for the purposes indicated, to: (1) subjects or entities which are legitimate beneficiary of communications provided by Law or Regulations; (2) companies that provide outsourcing operations and which are engaged for administrative services; (3) companies of JO Group; (4) consultants of the company. The data can be also divulged abroad. The provision of the data necessary to the fulfillment of law obligations is compulsory for any further purpose to the simple visualization of the site: any failure could lead to a failure to proceed and/or the inability to continue with the relationship between the parties. JO Group states that the data will be used in such a way as to guarantee their security and confidentiality, and they will be subject to special security measures, on the basis of Legislative Decree 196/2003 in order to prevent any risk of destruction and loss, even accidental, of the data or any unauthorized access, or any processing not consented and/or not in conformity with the indicated purposes. JO Group grants the exercise of the rights provided with Section 7 of Legislative Decree 196/2003 which contains some relevant rights to the data subject, as to obtain, without delay, from the Data Controller: confirmation as to whether or not personal data concerning him or her exist, the source of personal data and the logic applied to the processing; updating, rectification or, where interested therein, additions to the data; erasure, anonymization or blocking of data that have been processed unlawfully; certification to the effect that the operations above indicated have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected. According with Section 7 of Legislative Decree 196/2003, a data subject shall have the right to object, in whole or in part: on legitimate grounds, to the processing of personal data concerning him/her; to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
